1. GENERAL
Las presentes condiciones de compra, regirán la relación entre XUNZEL ENERGY S.L. y el cliente, y reemplazan cualquier otro término que aparezca en éste o en cualquier otro documento salvo que se indique lo contrario de manera específica por escrito y por parte de XUNZEL ENERGY S.L. Así pues, las presentes condiciones de venta anulan y excluyen cualquier otra estipulación incorporada por el cliente, bien en el propio pedido, bien durante cualquier tipo de negociación o transacción comercial en curso establecida entre XUNZEL ENERGY S.L. y el cliente, constituyendo el pleno entendimiento entre XUNZEL ENERGY S.L. y el cliente para la venta de los productos de la primera.
XUNZEL ENERGY S.L. responde por las obligaciones contenidas en las ofertas comerciales que realiza en su página web, durante su vigencia, y por todas las condiciones de venta, facturación y entrega de productos que consten expresamente o no en el contrato entre XUNZEL ENERGY S.L. y el cliente.
2. PRECIO
XUNZEL ENERGY S.L. informará en todo momento del precio aplicable a cada producto. La venta de los productos se llevará a cabo, en todo caso, por el precio que aparece en la página web al momento de realizar el pedido. El prestador se reserva el derecho de modificar los precios que se muestran en la presente página web sin previo aviso.
Los precios que se indican respecto a cada producto incluyen el Impuesto sobre el Valor Añadido (IVA) español y, en todo caso, se expresarán en la moneda euro (€). Salvo que se indique expresamente lo contrario, el precio del producto no incluye los gastos de envío. Los gastos de envío serán añadidos en el resumen de la compra, antes de efectuar el pago.
3. REALIZACIÓN DE PEDIDOS
XUNZEL ENERGY entregará las referencias del pedido realizado por el cliente, reservándose el derecho de sustituir el artículo por otro similar previa información y aprobación por parte del cliente.
Todos los pedidos están sujetos a la disponibilidad de los artículos. Siempre que se realice el cobro de un pedido completo, pero, por diversas circunstancias, no se entregue la cantidad total de productos incluidos en el pedido, la cantidad correspondiente al precio de los productos que no sea posible suministrar se considerará cancelada y se reingresará el importe correspondiente habiendo informado previamente al cliente.
4. ENTREGA DE PEDIDOS
Las entregas se efectuarán en la dirección de entrega indicada en el pedido, por el medio de transporte y transportista elegido por XUNZEL ENERGY S.L.
Las entregas se realizarán a zonas geográficas de España Peninsular, Baleares y Portugal Continental.
Los pedidos voluminosos y/o pesados, se entregarán a pie de calle y/o vehículo, es decir, en el punto más cercano a la dirección indicada en el pedido con accesibilidad con carretera transitable para camión con plataforma. No incluye acarreo.
El tiempo estimado de entrega es de 5-7 días hábiles para los pedidos de España Peninsular y Portugal Continental; 7-10 para los pedidos de Baleares.
Los productos con plazos de entrega mayores estarán indicados en el producto.
Dependiendo de los artículos comprados, se permitirán, previo acuerdo con el cliente, varias entregas para un mismo pedido.
Los gastos de envió en España Peninsular, Baleares y Portugal Continental son gratuitos para compras superiores a 200€. Para las compras inferiores a 200€ los gastos de envío son de 9,99€ (IVA incluido), serán a cargo del cliente y se incluyen en la factura bajo el concepto «Envío».
XUNZEL ENERGY S.L. no asume ninguna responsabilidad cuando la entrega de un pedido no pueda efectuarse como consecuencia de que los datos facilitados no sean correctos o estén incompletos.
Al hacer la petición del pedido, se asume que el cliente conoce y acepta las condiciones generales de venta que figuran en nuestro catálogo en vigor en la fecha de realizar el pedido.

5. INSPECCIÓN, RETRASOS DE TRÁNSITO Y NO-ENTREGA
El cliente deberá inspeccionar los productos dentro las 24 horas tras la entrega. En caso de observar cualquier defecto en los productos o en caso de producirse cualquier otra incidencia relacionada con el suministro realizado, incluidas la entrega incompleta, errónea y la no entrega de uno o más productos contenidos en el pedido, deberá notificarlo de la forma más detallada posible a XUNZEL ENERGY S.L. escribiendo un email a online.eu@xunzel.com.
Si el cliente no realizara tal notificación en el plazo indicado, se asumirá de manera definitiva que los productos están, en todos los aspectos, de acuerdo con el contrato y libres de cualquier defecto que resultase evidente en un examen razonable, y, en consecuencia, se considerará que el cliente ha aceptado los productos.
Productos dañados durante el transporte
Si observas algún daño o golpe en la caja al recibir el pedido, haz constar en el albarán de recepción de la empresa de transporte el problema (ej; “paquete dañado”) y devuelva la caja sin abrir al transportista; informa de la incidencia de inmediato a nuestro equipo de atención al cliente escribiendo un email a online.eu@xunzel.com.
Si un artículo llega incorrecto
Si en alguna ocasión, por error, te llega un artículo que no has pedido, envía un email a online.eu@xunzel.com.
6. TRANSMISIÓN DEL RIESGO Y DE LA PROPIEDAD
El riesgo de pérdida o daño de los productos se transferirá al cliente en el momento de la entrega. Por el contrario, la propiedad de los productos, no se transmitirá al cliente hasta que todas las sumas debidas a XUNZEL ENERGY S.L. por parte del cliente hayan sido abonadas.
El impago de las cantidades adeudadas en concepto de precio y gastos por parte del cliente, dará lugar a la resolución del contrato a instancias del vendedor. La falta de entrega del bien por parte del vendedor, dará lugar a la resolución del contrato a instancias del cliente.
7. GARANTÍA
XUNZEL ENERGY S.L., previo diagnóstico técnico, garantiza el reemplazo o reparación de los productos suministrados que no cumplan las condiciones bajo las que fueron vendidos, en los 2 años posteriores a la entrega y cuya causa sea debida a errores de fabricación. Esta garantía solo será válida para el cliente original del producto y no cubre en ningún caso el desgasto habitual del producto ni mal uso ni manipulación por parte del cliente.
El cliente deberá mantener en buen estado de uso el producto adquirido de conformidad con las instrucciones y recomendaciones entregadas en el libro de instrucciones y los manuales.
En caso de ejercicio de esta garantía el cliente deberá aportar a XUNZEL ENERGY S.L. la copia del documento de adquisición del producto (factura de compraventa).
La garantía no es aplicable en ningún caso a roturas o defectos derivados de una utilización negligente, del montaje de otros elementos accesorios no originales a los suministros o montados por la fábrica, o de manipulaciones y operaciones de mantenimiento inadecuadas por parte del cliente, o por cualquier tercero en nombre de este.
La garantía no es aplicable en ningún caso a los componentes del sistema eléctrico que hayan sido desmontados o hayan sufrido modificaciones para alterar sus funciones sin la autorización previa de XUNZEL ENERGY.
La aplicación de la garantía estará sujeta a la decisión de nuestros técnicos, acerca de la naturaleza de la falta de conformidad del producto, tras un estudio del aparato en cuestión.
Para ejercer el derecho de garantía en el período de 2 a 3 años tras la adquisición del producto, el cliente deberá justificarlo con un peritaje industrial que acredite que el defecto se debe a defecto de fabricación y que el uso y mantenimiento del producto ha sido correcto desde su compra.
8. INFORMACIÓN SOBRE LOS PRODUCTOS
A menos que se declare lo contrario, las especificaciones eléctricas representan los límites de funcionamiento seguro. Las dimensiones y otras características físicas están sujetas a las tolerancias comerciales habituales. El cliente será responsable de asegurarse de que el producto que ha adquirido es el adecuado para su proyecto o aplicación. XUNZEL ENERGY S.L. recomienda que el cliente verifique las dimensiones y otros datos publicados en esta web junto con la disponibilidad de stock futura antes de incorporar los productos en diseños y cualquier otra aplicación o propósito crítico.
El servicio de información técnica de XUNZEL ENERGY S.L. estará a disposición del cliente para aconsejarle en éstos y otros asuntos relacionados con el uso de los productos.
Las informaciones que XUNZEL facilita en su página web relacionadas con cada uno de sus productos, son las informaciones oficiales, salvo error o modificación. XUNZEL ENERGY S.L. se reserva el derecho de modificación en cualquier momento.
Cuando el cliente tenga la intención de suministrar los productos a cualquier otra persona, el cliente se asegurará de que no se ha perdido ni dañado en forma alguna ninguna advertencia, etiqueta, instrucción, manual ni ninguna otra información relativa a los productos o a su utilización, mientras estén en su posesión o bajo su control, y de que serán suministradas con los productos cuando dejen de estar en su posesión o bajo su control.
9. DECLARACIÓN DE CONFORMIDAD Y MEDIOAMBIENTE
Todos los productos de XUNZEL ENERGY S.L. se ajustan a la legislación en vigor en la Unión Europea en cada momento. Los productos XUNZEL cumplen con las normas correspondientes de conformidad para el marcado CE.
Además, XUNZEL ENERGY S.L. adopta todas las medidas necesarias relativas a la correcta gestión ambiental de sus productos cuando se convierten en residuos, siendo miembro de los necesarios Sistemas de Recogida como ECOEMBES, organización que cuida del medio ambiente a través del reciclaje y el eco diseño de los envases, ECOPILAS, ECOASIMELEC, RAEES, etc.
XUNZEL ENERGY S.L. cumple las legislaciones que establecen las normas aplicables a la fabricación del producto y las relativas a su correcta gestión ambiental cuando se conviertan en residuo.
10. RESPONSABILIDAD
Las condiciones establecidas en la cláusula 7 («Garantía») recogen la responsabilidad máxima que asumirá XUNZEL ENERGY S.L. en relación con los productos. La responsabilidad asumida por XUNZEL ENERGY S.L. bajo estas condiciones reemplazará y excluirá el resto de garantías, condiciones, términos y responsabilidades relativas a la calidad o la adecuación de los productos para cualquier propósito particular, excepto aquellos que, por estar impuestos de forma imperativa por ley, no puedan ser válidamente excluidos.
En ningún caso podrá entenderse que XUNZEL ENERGY S.L. confiere en favor de los clientes garantía comercial adicional alguna a la descrita en la cláusula 7.

Los pagos de los productos se realizarán previa confirmación de la compra y de alguna de las siguientes maneras:
12. DEVOLUCIONES Y CANCELACIONES
Condiciones de devolución
Para realizar cualquier devolución es necesario tener un número de reclamación asociado al pedido. El cliente siempre deberá solicitar a XUNZEL ENERGY S.L. un número de devolución, el cual deberá figurar en la etiqueta del paquete a devolver. Para ello ponte en contacto con atención al cliente de venta online mediante el email online.eu@xunzel.com.
En el caso de devolución por desistimiento o error por parte del cliente, éste deberá devolver el/los producto(s) dentro de los catorce (14) días naturales siguientes a la recepción del material. El producto deberá estar en las mismas condiciones en las que se entregó, sin utilizar, con su embalaje (sin haberlo desembalado) y etiquetas originales, incluyendo los manuales correspondientes y accesorios originales si los hubiera. Los gastos de la devolución correrán por cuenta del cliente. Durante el proceso de devolución, el cliente es responsable de cualquier pérdida o daño de el/los producto(s).
Gastos de devolución si el producto pesa 15 kilos o menos
Si el producto pesa 15 kilos o menos, los gastos de devolución para devoluciones desde España peninsular, Baleares y Portugal continental son de 9,99€ (IVA incluido).
Gastos de devolución si el producto pesa más de 15 kilos o productos voluminosos
Si el producto pesa más de 15 kilos o es un producto voluminoso, los gastos de devolución para devoluciones desde España peninsular, Baleares y Portugal continental son de 30€ (IVA incluido).
El Cliente devolverá los productos objeto de desistimiento sin ninguna demora indebida en el plazo máximo de catorce (14) días naturales a partir de la fecha en que comunique a XUNZEL ENERGY S.L. su decisión de desistimiento.
En caso de que se ejercite el derecho de desistimiento XUNZEL ENERGY S.L. devolverá el importe a través del mismo medio de pago empleado por el cliente. La devolución incluirá el importe de la compra y, si hubieran existido, los gastos de envío iniciales. La devolución del importe se realizará a más tardar 14 días naturales a partir de la fecha en la que se informe la decisión de desistir del contrato. No obstante, se podrá retener el reembolso hasta haber recibido y analizado los bienes.
En caso de que el cliente haya realizado el pago mediante Bizum deberá confirmar con su entidad bancaria que tiene activado el servicio de devoluciones a través de Bizum.
La asignación de un número de devolución no implica la aceptación de la misma por parte de XUNZEL ENERGY S.L. La aceptación está sujeta a la inspección del material por parte del personal cualificado de XUNZEL ENERGY S.L., tras recibir el paquete devuelto. Nos reservamos el derecho de no hacer una devolución completa del importe si el producto no es devuelto en su totalidad y/o correcto estado.
Los pedidos de artículos bajo pedido no están sujetos a cancelaciones ni a devoluciones.
Cancelaciones de Pedidos
Las cancelaciones totales o parciales de un pedido sólo pueden ser aceptadas tras acuerdo previo y acordar la compensación a XUNZEL ENERGY S.L. por todos los gastos incurridos. En caso de cancelación parcial, XUNZEL ENERGY S.L. se reserva el derecho de facturar cualquier diferencia en el precio de venta aplicable a la cantidad entregada en el momento de la cancelación.
Los pedidos de artículos bajo pedido no están sujetos a cancelaciones de pedidos ni a devoluciones.

El prestador no asume responsabilidad alguna sobre los enlaces externos a sitios web de terceros o por la información que los mismos contengan, que pudieran incluirse en la página web, por lo que el cliente accede bajo su exclusiva responsabilidad al contenido y en las condiciones de uso que rijan en los mismos.
El prestador se reserva el derecho de retirar cualquier enlace, en cuanto tenga conocimiento de la ilicitud de su contenido o de que el mismo lesione bienes o derechos de terceros.

Si XUNZEL ENERGY S.L. se viese imposibilitada o impedida para ejecutar cualquier contrato debido a alguna causa más allá del control razonable de XUNZEL ENERGY S.L. o por su incapacidad de proporcionar los servicios, materiales o artículos requeridos para la ejecución del contrato excepto a un precio más alto, XUNZEL ENERGY S.L. puede, a su solo criterio, retrasar la ejecución del contrato o cancelarlo en su totalidad o en parte.
XUNZEL ENERGY S.L. no será considerada responsable por dicho retraso, cancelación o incapacidad para entregar cualquier pedido. En particular, y aunque XUNZEL ENERGY S.L. utilizará todos los esfuerzos razonables para entregar los pedidos en la fecha establecida, en ningún caso será considerada responsable por retrasos, cancelaciones o incapacidades para entregar dichos productos.
16. LEY APLICABLE
Los contratos celebrados entre XUNZEL ENERGY S.L. y el cliente se interpretarán y regirán por la Ley española. Las partes renuncian expresamente al fuero que les pudiera corresponder y someten expresamente a los Juzgados y Tribunales de Gipuzkoa para resolver cualquier controversia que pueda surgir en la interpretación o ejecución de las presentes condiciones contractuales.
17. NEGOCIO DE EXPORTACIÓN
En el caso de que los productos suministrados sean exportados directamente por el cliente, éste será responsable, en exclusiva, de la obtención de cualquier licencia necesaria y del cumplimiento de cualquier regulación de exportación en vigor en España y en el país a que esté destinada la mercancía, sin que XUNZEL ENERGY S.L. asuma responsabilidad alguna en el caso de reexportación por parte del cliente de nuestros productos a terceros incumpliendo la ley aplicable en materia de exportación.

18. PROTECCIÓN DE DATOS
XUNZEL ENERGY S.L., con domicilio social en calle Igartualdea 57, ES-20850 Mendaro (Guipúzcoa), es la titular de la base de datos generada con los datos de carácter personal suministrados por los clientes, a fin de que pueda ejercer los legítimos derechos que le corresponden.

This website offers an Interactive Product Guide to help users find the product that best suits their needs. This service is provided by XUNZEL’s supplier, Zoovu (Germany) GmbH, Skalitzer Str. 104, 10997 Berlin. We use this tool on our own responsibility and have entered into a data processor contract with Zoovu which stipulates that customer data may only be processed on the basis of our instructions, may not be passed on to third parties and must be sufficiently protected technically.
When you use the service and if you have given us permission to do so, e.g. by giving us your consent via the tracking banner, we collect the following usage data:
– Event data: (performance of the digital assistant, answers to questions, navigation, product recommendations, purchase).
– Browser / operating system / device used

We use this collected data (through the use of a cookie ID) to improve the Digital Assistant experience as well as for technical purposes to improve the service. Your IP address is not collected; therefore, it is not possible to deduce the identity of the user from the ID used.
